1. General

Nova Korea Holdings Co., Ltd. ("Company") complies with the Personal Information Protection Act of Korea ("PIPA") and related laws, and publishes this Privacy Policy under PIPA Article 30 to explain what personal information it processes, why, and how it is protected.

2. Scope and controller

This policy applies to personal information processed through the enquiry form on novakorea.holdings ("Website") and enquiries sent by email. The Website offers no sign-up, log-in or payment functions and collects no personal information by other means. The controller is Nova Korea Holdings Co., Ltd. Third-party websites linked from the Website are governed by their own policies.

3. Information processed and how it is collected

We do not collect sensitive information or unique identifiers. Please do not include such information, or other people's personal information, in your message.

4. Purposes

• Receiving, verifying and responding to enquiries
• Discussions on capacity reservation, investment, partnership and public-sector cooperation
• Dispute handling, record-keeping and legal compliance
• Website security and abuse prevention

Any change of purpose will be handled under PIPA Article 18, including obtaining separate consent where required.

5. Retention

Longer retention may apply where required by law or during investigations.

6. Provision to third parties

We provide personal information to third parties only as permitted by PIPA Articles 17 and 18. Where your enquiry needs to be shared with our shareholders (Aleria Technology LLC, UAE; Metric Korea Co., Ltd., Korea) or project partners, we will tell you the recipient, purpose, items and retention period and obtain your separate consent in advance, including the disclosures required by PIPA Article 28-8 for overseas recipients.

7. Outsourcing

Our outsourcing arrangements address the matters required by PIPA Article 26, and we supervise processors' handling of personal information. Changes will be published in this policy.

8. Cross-border transfer

The transfer is made under PIPA Article 28-8(1)(iii). You may refuse the transfer by writing to us at our registered address instead of using the form; written enquiries are not restricted.

9. Destruction

Personal information is destroyed without delay once no longer needed, with the approval of the Privacy Officer. Electronic files are permanently deleted by irrecoverable means; paper records are shredded or incinerated. Information retained under law is stored separately.

10. Your rights

You may at any time request access, correction, deletion or suspension of processing, or withdraw consent (PIPA Articles 35–37), through the "Send an enquiry" form (type: Privacy) or in writing to the Privacy Officer. We will act within 10 days. You may exercise these rights through a legal or authorised representative with a power of attorney. Some requests may be refused where the law requires the information to be kept. You must provide accurate information and must not use others' information.

11. Cookies and similar technologies

The Website uses no analytics, advertising or tracking cookies. Your language choice is stored only in your browser's local storage and is not sent to us; you can clear or block it in your browser without affecting use of the Website. Fonts are served by Google Fonts, which may receive technical data such as your IP address.

12. Security measures

Under PIPA Article 29 we apply administrative measures (internal management plan, minimal staff access, training), technical measures (access control, HTTPS, multi-factor authentication on business accounts, access logs) and physical measures (locked storage, access control).

Requests under PIPA Article 35 may be sent to the Privacy Officer above, or made through the Personal Information Portal of the Personal Information Protection Commission (www.privacy.go.kr).

15. Business transfers

If personal information is transferred due to a transfer of business or merger, we will notify you in advance under PIPA Article 27 of the transfer, the recipient's name, address and contact details, and how to object.

16. Marketing messages

We do not send commercial advertising without your prior express consent (Network Act Article 50), and do not use enquiry contact details for marketing.

17. Children

The Website is intended for business and institutional users. We do not knowingly collect information from children under 14 and will delete any such information without delay.

18. Automated decisions

We do not make fully automated decisions that significantly affect your rights or obligations (PIPA Article 37-2).

20. Changes

Changes will be announced on the Website at least 7 days before they take effect (30 days for material changes). Previous versions are available from the Privacy Officer.

1. Purpose

These Terms govern the rights, obligations and responsibilities of Nova Korea Holdings Co., Ltd. ("Company") and users in connection with the website at novakorea.holdings ("Website").

2. Definitions

1. "Website" means the website, sub-pages and enquiry form operated by the Company to present the NOVA Hadong Sovereign AI Factory ("Project") and the Company.
2. "User" means anyone who accesses and uses the Website.
3. "Content" means all text, figures, drawings, images, designs and logos published on the Website.
4. "Enquiry" means any communication and information a User submits through the form or by email.

3. Effect and amendment

These Terms take effect when posted, and use of the Website constitutes acceptance. The Company may amend them in compliance with law, announcing the effective date and reasons at least 7 days in advance (30 days for changes adverse to Users). Continued use after the effective date constitutes acceptance; Users who disagree may stop using the Website.

4. Other rules

Matters not covered here are governed by applicable law and commercial practice. Any separate agreement between the Company and a User (such as an NDA, MOU or capacity reservation agreement) prevails over these Terms.

5. Provision, change and suspension

The Website is provided free of charge for information and enquiries. The Company may change or suspend all or part of it without notice for operational or technical reasons, and is not liable for interruptions due to maintenance, failures or force majeure.

6. Nature of information; forward-looking statements

Content is for general information and includes targets, plans and estimates for a Project under development. Capacity, schedules, investment amounts, sites, power allocations, technical specifications and partner roles depend on definitive agreements, government and local approvals (including change of permitted use), KEPCO supply confirmation, financing and market conditions, and actual results may differ materially. The Company does not warrant the accuracy, completeness or currency of Content and has no duty to update forward-looking statements. Drawings and images are illustrative.

7. No offer or advice

Nothing on the Website is an offer, sale, subscription or solicitation of securities or financial investment products under the Financial Investment Services and Capital Markets Act or any other law, nor investment, legal, tax, accounting or technical advice. Users should seek independent professional advice.

8. Enquiries and submitted information

Submitting an Enquiry, or receiving a reply, does not create a contract, reserve or allocate capacity, or constitute any binding commitment; binding rights arise only under a separate written agreement. Users must not submit trade secrets or other confidential information; these should be shared only after an NDA is signed, and the Company owes no confidentiality obligation for information submitted before then. Users warrant that submitted information is accurate and does not infringe third-party rights.

9. Prohibited conduct

1. Impersonating others or submitting false information
2. Copying, distributing, modifying or commercially exploiting Content without prior written consent
3. Collecting Content or email addresses by crawlers, scrapers or other automated means
4. Unauthorised access, vulnerability scanning, hacking, denial-of-service attacks or distributing malware
5. Sending spam, advertising or bulk messages through the enquiry form
6. Defaming or infringing the rights of the Company, its shareholders, partners or third parties
7. Falsely claiming affiliation with the Company or the Project, or using the Company's name or logos without permission
8. Any other conduct contrary to law or public order

10. Intellectual property

All intellectual property in the Website and Content belongs to the Company or its rightful owners. "NOVA", "NKH" and related logos are the Company's trade names and marks. Users may view Content for personal, non-commercial purposes only; no licence is granted.

11. Third-party marks and links

NVIDIA, Vera Rubin, DSX and Omniverse are trademarks of NVIDIA Corporation. Other company, product and service names belong to their respective owners, are used for identification only and do not imply endorsement, sponsorship or affiliation. The Company is not responsible for linked third-party websites.

12. Privacy

Personal information is handled under PIPA and the Company's Privacy Policy.

13. Disclaimer

The Website and Content are provided "as is" without express or implied warranties of merchantability, fitness for a particular purpose or non-infringement, to the extent permitted by law. The Company is not liable for decisions made in reliance on Content, interruptions or errors, or losses caused by Users or third parties.

14. Limitation of liability

To the maximum extent permitted by law, the Company is not liable for indirect, special or consequential damages or lost profits arising from use of the Website, except for damage caused by its wilful misconduct or gross negligence or where limitation is not permitted by law.

15. User indemnity

Users who breach these Terms or the law shall compensate resulting losses and hold the Company harmless from related third-party claims.

16. Notices

The Company may give notice by posting on the Website or by email to the address a User has provided. Notices to the Company should be given through the website enquiry form or in writing to the registered address.

17. Severability and no waiver

If any provision is held invalid or unenforceable, the rest remains in effect. Failure or delay in exercising a right is not a waiver.

18. Language

These Terms are written in Korean and English; the Korean version prevails.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Korea. The Seoul Central District Court has exclusive jurisdiction at first instance.

Addendum

These Terms take effect on 28 October 2026.

1. What we refuse

Nova Korea Holdings Co., Ltd. refuses, without its prior consent, the following in respect of any email address published on or contained in novakorea.holdings, its sub-pages, enquiry form or source code (including our staff's addresses):

1. Collecting email addresses using harvesting programs, crawlers, scrapers or other technical means
2. Selling, distributing or sharing addresses collected in that way
3. Using such addresses to send commercial advertising

2. Applicable law

Network Act Article 50-2 prohibits (i) collecting email addresses from a website using automated programs or other technical means without the operator's prior consent, (ii) selling or distributing addresses so collected, and (iii) knowingly using such addresses to send information.

Network Act Article 74 — violations of Article 50-2 may be punished by imprisonment of up to one year or a fine of up to KRW 10 million.

Network Act Article 50 — commercial advertising sent electronically requires the recipient's prior express consent; violations may incur administrative fines.

3. Our response

Where we identify unauthorised collection, sale or use of our email addresses, we may report it to the authorities and take legal action.
